These terms and conditions set out the legal terms that apply to your use of the website www.nomadwear.ae and Nomad Wear mobile device application developed by us.

Nomad Wear is digital platform name of Nomad Wear Portal LLC, a company registered in the United Arab Emirates under the laws of Dubai with License Nr 1556634, website www.nomadwear.ae, herein referred as “Nomad”, “Nomad Wear”, “we”, “us”, “our”.

The services we offer allow Internet Users to search fashion products from our Partner brand outlets and arranging a delivery of the products to User’s address via subcontracted delivery partners.

The User is a person of legal age and engaging Nomad platform and/or mobile application for shopping online (herein referred as “User”, “you”, “yours”).

The use of Nomad services shall be regulated by this Agreement.

By starting the use of any services/certain functions or going through the registration procedure, the User shall be deemed to have accepted the terms of this Agreement in full without any limitations or exceptions. If the User does not agree to any provisions of this Agreement, the User must not use Nomad services.

This Agreement may be amended by Nomad without notice, and a new revision of this Agreement shall take effect when posted online at the web address given in this paragraph, unless otherwise stated in the new revision of this Agreement. The current revision of this User Agreement is always available at https://www.nomadwear.ae

The terms and conditions of this Agreement are provided in English. In the event of any conflict and/or discrepancy between the communication or notices exchanges in any other languages, the English version shall prevail.

Scope of Service

Nomad Wear is a UAE-based digital online delivery platform that facilitates the pickup of fashion products from partner brand outlets and delivers them to customers (Users) within designated delivery zones. Our role is limited to providing services for its Users by linking retail brands / merchants with third-party logistics providers. We are not the seller or manufacturer of the products. Partner brands operate independently and are responsible for the products they offer. By using Nomad Wear’s services, including selecting Nomad Wear as a delivery option at checkout, you agree to these Terms of Service.

Eligibility and Account Registration

You must be at least 18 years old to use Nomad Wear’s services. By agreeing to these Terms, you confirm that you are legally capable of entering into contracts. You may be required to register an account to access certain features. You are responsible for maintaining the accuracy of your information and the confidentiality of your account. Any activity under your account will be deemed to be yours.

• To use certain Nomad services or certain specific functions of services, the User shall complete registration to create a unique account.
• Upon registration the User shall provide valid and complete information requested in the registration form and shall regularly update such information. If the User provides invalid information or Nomad has reasons to believe that any information provided by the User is incomplete or invalid, Nomad may at its discretion block or delete the User’s account or deny the User the use of any services (or certain functions).
• Nomad shall reserve the right to require at any time that the User verify the information provided upon registration and to request supporting documents (personal identification documents in particular); failure to provide these documents may, at Nomad's discretion, be regarded as provision of invalid information and entail consequences according to Clause 2.2 hereof. In case the User's information specified in the documents provided by him/her fails to conform to the information provided upon registration or if the information provided upon registration does not make it possible to identify the User, Nomad shall reserve the right to deny User's access to the User account and to usage of Nomad services.

Placing Orders and Acceptance

Orders are placed on our partner brands’ websites where Nomad Wear is available as a shipping option. Your order is only confirmed once accepted by both the brand and Nomad Wear. We reserve the right to refuse or cancel any order due to delivery area restrictions, logistics limitations, or other reasons. You agree to pay all charges, including product costs and delivery fees, as shown at checkout.

Service Availability and Delivery

Nomad Wear only delivers within specified delivery zones. If your address is outside these zones, the option to select Nomad Wear will not be available. All delivery times are estimated and not guaranteed. Delays may occur due to traffic, weather, or other unforeseen factors.

The User must ensure a person of legal age is available at the delivery address to receive the order. Failed deliveries due to any of the following conditions: 1) incorrect or incomplete address; 2) unavailability of person to receive the order at the delivery address; 3) the User was uncontactable despite attempts to reach the customer via the phone number provided; 4) unsuitable or unsecure location to leave the Order; 5) incomplete address or restricted access to the delivery address, may still incur a delivery charge.

Wrong Order, Missing Order, Defective Items

Upon receipt of your Order, if you discover that there are issues with your Order (e.g. wrong order, defective order, or missing items) please contact customer support via our in-app customer support chat feature immediately. In some cases, you may be requested for photographic proof and/or additional information to properly investigate the issue with your Order.

Late Delivery

If your Order is significantly delayed from the estimated delivery time, please contact customer support via our in-app customer support chat feature immediately.

Prices and Payment

Product prices are set by partner brands. Delivery fees, where applicable, are displayed at checkout. All charges are in AED and include VAT unless stated otherwise. Payment may be collected online or via cash on delivery, depending on the brand. You authorize the total amount to be charged upon order confirmation.

Cancellations and Returns

Orders may only be cancelled before they are processed or dispatched. If cancelled after dispatch, delivery fees may still apply. Returns and refunds are governed by each brand’s return policy. Nomad Wear only facilitates returns once the brand approves the request. We are not responsible for approving or denying product returns or issuing refunds.

Partner Brands and Third-Party Services

Nomad Wear is not responsible for the accuracy or quality of third-party services, including partner brand websites. The sale-purchase agreement is between you and the brand. Any product-related issues must be resolved with the brand directly. Nomad Wear may work with third-party couriers and technology partners to fulfill orders.

Limitation of Liability

Nomad Wear provides its services "as is" without warranties. We are not liable for the quality or safety of products sold by brands or for any indirect, incidental, or consequential damages. Our total liability in any case is limited to the delivery fee paid for the specific order in question.

• The User uses Nomad services at his own risk. Services are provided as is. Nomad accepts not responsibility including for compliance of services with the User's goals.
• Nomad does not guarantee that services comply/will comply with User's requirements; that services will be provided without interruptions, promptly, sustainably and without errors; that results received with the use of services are accurate and reliable and may be used for any purposes or in any capacity (for instance, for identification and/or verification of any facts); that the quality of any product, service, information, etc. received through the services will meet the User's expectations.
• Any information and/or materials (including downloadable software, messages, any instructions and guidelines, etc.) which the User accesses through Nomad services may be used by the User at his own risk and the User shall be responsible for any potential consequences of the use of such information and/or materials including any damage to the User’s computer or third parties, loss of information or any other damage
• Nomad shall not be liable for any losses resulting from the User using Nomad services or separate parts/ functions of services.

Indemnification

You agree to indemnify and hold Nomad Wear and its affiliates, directors, employees, agents harmless against any claims, losses, or liabilities arising from your use of the service, breach of these Terms, or violation of third-party rights.

Force Majeure

For the purposes of this terms and conditions, "Force Majeure" shall mean in respect of any party of this Agreement, any event or occurrence whatsoever beyond the reasonable control of that party, which delays, prevents or hinders that party from performing any obligation imposed upon that party under this Agreement, including, to the extent such event or occurrence shall delay, prevent or hinder such party from performing such obligation, by way of example only: war (declared or undeclared), guerrilla activities, terrorist activities, acts of sabotage, blockade, fire, national strikes, riots, insurrections, civil commotions, quarantine restrictions, epidemics, earthquakes, ground movements, tremors, landslides, avalanches, floods, hurricanes, explosions and regulatory and administrative or similar actions or inactions of any governmental authority.

A party affected by a force majeure event shall be excused performance of its obligations which are prevented by such force majeure event but shall nevertheless take all reasonable measures available (at its own cost) to overcome and mitigate the effects of such force majeure event, including cooperating with the other PARTY to develop and implement a plan of remedial action and reasonable alternative measures to remedy the effects of such force majeure event.

Notices and Communication Exchange

All notices and other communications between the parties required shall be in writing in the English language. Such notices and other communications may be served via mobile application chat or email address.

Changes to Terms

We may update these Terms at any time. Changes will be communicated via our website or app. Continued use of our services after updates constitutes your acceptance of the revised Terms.

Governing Law and Dispute Resolution

These Terms and conditions are governed by the laws of the United Arab Emirates. Any disputes will be subject to the exclusive jurisdiction of UAE courts. If any provision is deemed invalid, the remainder of the Terms will remain enforceable.
